Many contract disputes could be avoided if the parties got certain fundamentals right at the outset of the relationship. In this session, our speakers will take a close look at some of the issues that come up at the start of contract relationships, looking both at complex bespoke contracts and contracts based on standard form terms and conditions:

The Who: Graeme Bruce, a Partner in our Corporate team, will look at issues with parties, including selection of contract parties and authority and capacity to contract;
The Why: Duncan Turner, a Partner in our Technology and Media and Telecoms team, will look at the issue of contract scope, the dangers of scope creep, and how to plot the critical path when negotiating complex contract arrangements; and
The What: Will Anderson, a Partner from our Disputes team, will consider the latest case law on the battle of the forms, how to determine whose terms will prevail in the event of a conflict, and how to avoid such battles arising.
